Commercial Mortgage Broker Fee Agreement

Now having a good commercial mortgage broker agreement in place with your borrower is more important than ever. As CMBS lenders like Lehman, Silver hill, etc have been taking the worst of it, we as commercial mortgage brokers are now forced to originate our commercial mortgages through traditional sources, i.e. regional or smaller banks.

These banks that for years saw their market share shrink are now in control. Many of them never bothered to increase their risk thresholds and or change their underwriting guidelines to stay competitive. They are now reaping the rewards of that prudence. Bottom line, they still have money to lend and many times their rates are considerable better than the rest of the market.

The challenge however for commercial brokers is that most of these smaller banks are not broker friendly. Or more accurately stated most of them are not set up to work with brokers like the CMBS lenders. For example it’s very rare that a smaller bank will pay rebate or ysp. Once in a while you may find a bank that will pay a .5% or 1% referral fee, but that’s it and it’s rare to find.

Rather many of these banks expect you to get paid on top of their 1% bank fee. Or worse many of them will want you to make your fee outside of close… When was the last time you chased a borrower for a $15,000 commission? If you don’t have it set up right from the beginning you will have a difficult time ever collecting. And besides collecting you will have a hell of a time competing on the deal.

So the point here, besides that this current market reality is not a lot of fun, is that if you think you’ll have to take your deals to a local banks, you’d better have your commercial mortgage broker fee agreement signed and in place before you bother to work on the deal.

Productivity Measurements and Telecommuting

Over the years, the improved channels of telecommunication have paved the way for an increase in number of Telecommuting jobs. Telecommuting occupations are not your typical office work and that is why, it has become a focus of productivity measures issues. There are a lot of myths that surround telecommuting and Productivity Measurements. Some say that measuring productivity is much more difficult in telecommuting rather than in regular office work.

Before going forward, let us first individually define what Productivity and what Telecommuting is. Productivity (in Economics) refers to the amount of output produced in a specific amount of time. In a factory or office setting, this can easily be computed by dividing the number of units of output with the time spent to produce them. For example, an office worker is given the task to compile kits for the participants of a lecture. He was able to compile 25 kits in 1 hour, and that becomes his productivity rate.

Quantitative data is more easily translated into productivity rates rather than qualitative data. On the other hand Telecommuting (otherwise known as working from home) is form of work where the employee works on his or her own schedule. It is called telecommuting because the time and process of commuting to and from the work place are replaced by links of telecommunication. A few of the most popular telecommuting tasks is Medical Transcription and Insurance Underwriting.

The issue that lies between Productivity measurement and Telecommuting are claims saying that Productivity measurement is harder to achieve than with regular office work. This is claimed to be the major downfall of telecommuting. Because of this, employer supposedly has no hold on the productivity of their personnel who work form home.

However, that is really not the case. Productivity Measurements are still easily achievable with Telecommuting Jobs. The rate telecommuting employee works, is the same with every project that he/she receives. A Medical Transcriptionist may complete transcription of 5 files in an hour. No matter how many hours a day a medical transcriptionist chooses to work, his or her hourly rate is still the same.

Another myth about productivity measurement and telecommuting is that an employer has no hold on how much an employee works on a set number of days. This is contradicted by the fact that employers enforce deadlines that a Telecommuting employee must adhere to. In example, an Underwriter is given 10 insurance policies to process in a span of 4 days. It is of no consequence to the employer how his or her Underwriter divides the task over 4 days as long as it is completed within the set number of days.

Telecommuting is a practice that will undoubtedly continue to grow. Despite early fears that it may not be a as easy to regulate and measure as regular office work, it has been proven that it is not so. That is the reason why employers should not shy away from hiring telecommuting personnel because they can still measure and regulate their productivity rate despite not having set office hours.

A Verbal Contract is As Binding As a Written One

It is surprising how valuable lessons can be learned from one’s computer letter archives; which often seems easy to dismiss as a heap of unwanted files. I was pleasantly surprised with this one, and I thought it needed to be shared. If only to remind us that we must constantly and consistently be true to our words.

My case in point is a letter which I wrote several years ago; which I have “rediscovered” quite recently. The following is my actual letter to an office apprentice who found it convenient to terminate her term before it was completed. The name given below is fictitious, to protect her true identity.

Dear Carmen,

This will acknowledge receipt of your 13 May 04 letter, where you graciously informed me that you are resigning from your apprenticeship with the office.

It is with deep disappointment that I accept your resignation.

As I do so, allow me to call your attention to the matter of our verbal agreement and your commitment to abide with all office policies–foremost of which is to stay with the office for not less than one year. As they say: a verbal contract is as binding as a written one. In fact to me–it is even more binding. At least, that is so for those who reconcile with the fact that a piece of paper with promises on it and bearing one’s signature is not essential for those who can be true to their word. A critical matter, when it comes to living up to the ideal–as a real and sincere person.

Just because we have not placed our commitment to each another on paper, you seem to have fallen unto the incorrect notion that our commitment to one another is not mutually binding… or just an empty promise. Let me stress that this should not be so.

With no ill feeling in my heart, I trust that you have learned something from me; even if it were just the final lesson in being true to yourself.

Free Attendance Record Forms 101

There are numbers of free attendance record forms available on the internet for download. Each form features different forms and patterns for easier tracking and recording. There are for class attendance and employee attendance. These forms are usually in the form of Excel, OpenOffice and Google Spreadsheets.

Most of the free attendance record forms are created for weekly or monthly monitoring. For weekly class attendance form, a date is being entered in the field of Week for reference. Information such as teacher’s name, room # and course are indicated at the top for filling up. In the table proper comes the student’s name and names of the days of the week. Markings or symbols will depend on the leader or teacher. You can put “X” or corresponding letter for each performance. The monthly student attendance record is created and designed where the month, year, weeks and dates are used in column for reference. Likewise, the symbols or designation depends on the downloaded form or the leader assigned. There are forms that include time in the field to track tardiness and such.

Employee’s attendance record forms come in two types: the monthly attendance sheet and the daily time sheet. The daily time sheet is the type of record that is made to record information in details. Such data needed are the employee’s information, task description, time started and stopped, and total time worked. By this, the tardiness and absences are monitored daily as well as the position of certain employee for that day. The monthly in the other hand is not a detailed one. Only needs employee’s information, dates of the month, days, and columns for present, vacation, or sick that just need to be ticked.
