“There is no question that Ms. Lohan is entitled to bail while her alleged probation violation is being adjudicated,” Chapman Holley claimed.
Schnegg agreed, ruling that Judge Elden Fox overstepped his authority when he had deputies put her in cuffs.
Schnegg said California law guarantees defendants bail in misdemeanor cases and set bail along with some stringent conditions, including a new booze-monitoring SCRAM anklet which she must have fitted within 24 hours.
It will be the actress’ third time wearing the device.
Lohan was ordered to court because she flunked a recent drug test with cocaine in her system, a source told the Daily News.
She is due back in court on Oct. 22 for a probation violation hearing.
Lohan admitted her relapse on Twitter last weekend, saying she was ready to face the consequences.
She spent 14 days in jail over the summer for missing alcohol education classes and then served 23 days of a 90-day inpatient rehab sentence.
